New amendments to the sports betting law are being prepared in Peru

(Lima).- In October 2023, the Ministry of Foreign Trade and Tourism (Mincetur) published the regulations of law No. 31557, which creates the tax on online sports betting games. With this, since April nearly 50 companies that offer this type of services in Peru began to pay 12% of their net profit to the State. However, several changes are still to come. The Minister of Economy argued that, since in-person games are already subject to taxes, it is fair and equitable that remote games are also subject to the same tax regime.
Even though this law contemplated that non-domiciled (foreign) companies should be taxed, the process was not clear. Therefore, the Congress of the Republic made modifications to Law No. 31557. Despite all this, it seems that there are still obstacles for this to come to fruition, since the Ministry of Economy and Finance (MEF) points to new changes.
In the parliamentary session where the Adrianzén Cabinet requested the vote of confidence, the Minister of Economy and Finance, José Arista, announced the intention of the Executive Branch to present a rule to modify Law No. 31557 with the objective of regulating various aspects for the application and collection of tax on remote gaming and sports betting.
Minister Arista emphasized the need to establish a regulatory framework that allows the proper payment and declaration of this tax by foreign betting companies operating in Peru. He argued that since in-person games are already subject to taxes, it is fair and equitable that remote games are also subject to the same tax regime.
This proposal, if approved by Congress, would have significant implications in the field of online gaming and betting platforms, but above all, in public revenue.
Law No. 31557, which was approved in August 2022, had not been regulated for more than a year. Then it was modified in June of last year, when it was realized that its wording only taxed national companies and left out those that operate online, which represent 70% of remote gaming and sports betting activity.
